These Terms of Use ("Terms") govern your access to and use of the website enablingmedia.com, related subdomains, and any content, features, or services made available through them (collectively, the "Site"). The Site is operated by Enabling Media Inc. ("Enabling Media," "we," "us," or "our"), a Canadian corporation based in Calgary, Alberta.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The short version: Use the Site for legitimate purposes. Do not attempt to break, misuse, or copy it. Our content is our intellectual property. Use of our services is governed by a separate written engagement letter. We do our best but cannot guarantee outcomes. Alberta law governs.

1. Acceptance of Terms

By accessing, browsing, or interacting with the Site, you represent that you are at least the age of majority in your jurisdiction and are legally capable of entering into a binding contract. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of Services

The Site provides information about Enabling Media and the marketing services we offer, including paid advertising, social media management, email and lifecycle marketing, strategy and positioning, end-to-end campaign management, and CRM architecture. The Site also allows visitors to book discovery calls, subscribe to our newsletter, and contact us.

Any paid services we deliver are governed by a separate written engagement letter, statement of work, or master services agreement executed between you (or your organization) and Enabling Media. These Terms do not by themselves create a client relationship or obligate us to provide services.

3. Intellectual Property

The Site and all of its content — including text, graphics, code, design, logos, wordmarks, images, videos, downloadable materials, and the arrangement thereof — are owned by or licensed to Enabling Media Inc. and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view, share links to, and print reasonable portions of the Site for personal or internal business use only. You may not:

The Site may contain links to third-party websites, tools, and services (for example, Instagram, our booking calendar, or advertising platforms). We do not control and are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are governed by their own terms and policies.

6. User-Submitted Content

When you submit content to us through the Site (for example, form submissions, chat messages, or email inquiries), you represent that the content is truthful, does not violate any third-party rights, and does not contain unlawful material. You grant us a non-exclusive, royalty-free, worldwide license to use that content for the purpose of responding to you, delivering services, and improving our business, in accordance with our Privacy Policy.

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

Marketing outcomes depend on many factors outside our control, including your product, market, offer, and execution. Any performance data, case studies, or examples shared on the Site are illustrative and do not guarantee similar results for you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Enabling Media Inc., its directors, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Site, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to the Site is limited to CAD $100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Enabling Media Inc. and its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site in violation of these Terms or applicable law.

10. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or that termination is necessary to protect the Site, our users, or our business. Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

11. Changes to the Site or Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we do, we will update the "Last updated" date at the top of the page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the courts of Alberta located in Calgary, and you consent to the personal jurisdiction of those courts.

13. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written engagement letter or statement of work, constitute the entire agreement between you and Enabling Media Inc. regarding your use of the Site and supersede any prior agreements or understandings.
